CASE UPDATE – NOVEMBER 1, 2014

The deadline to cash or deposit settlement checks has passed. Please note that all outstanding checks have been voided and are non-negotiable effective November 1, 2014 and you will be responsible for any finance charges or recovery efforts that result from efforts to cash or deposit settlement awards after the October 31, 2014 deadline.

CASE UPDATE – SEPTEMBER 25, 2014

All claimants should note the following important deadlines:

  • Deadline to submit claim updates: October 10, 2014
  • Deadline to cash or deposit settlement checks: October 31, 2014

If you have not received a settlement check, the CADA may be missing key information regarding your claim. You can confirm that your information is up to date by submitting a Disbursement Update Packet to the CADA. To download a packet, please click here.

Please fill out the packet completely, and provide all required documentation. To submit the information to the CADA, you may:

  1. Scan and upload the documents via the case information update portal. To access the portal, click here. Please note that you will need the claim number on the postcard to submit an online update.
  2. Mail the documents to the CADA's office

CASE UPDATE – JULY 1, 2014

On July 1, 2014, the Court-Appointed Disbursing Agent (CADA) mailed a postcard to all claimants with approved allocations that have yet to claim awards in the settlement. To view a sample of this postcard, please click here.

If you received a postcard, you can confirm that your information is up to date by submitting a Disbursement Update Packet to the CADA. To download a packet, please click here.

Please fill out the packet completely, and provide all required documentation. To submit the information to the CADA, you may:

The deadline to submit missing information is 10/10/2014. If you receive a settlement award check, the deadline to cash or deposit the check is 10/31/2014.

CASE UPDATE - OCTOBER 31, 2013

On Thursday, October 31, 2013, the Court Appointed Disbursing Agent (CADA) initiated the distribution of settlement checks to all eligible class members in accordance with the signed Judgment and Order. Most claimants will receive a settlement check within four to five business days in accordance with standard mail delivery. If you have not received your check within several weeks of disbursement, please contact the Settlement Administrator at 1.800.728.1628.

In order for a class members settlement check to be disbursed, the CADA must have all required information for each claimant, including Date of Birth, Current Mailing Address, and Minor Representative/Deceased Successor information (if applicable). Case Update - October 2, 2013

On Tuesday, October 1, 2013, the Court approved the Special Master?s Recommendations Concerning Distribution of Settlement Funds and the Special Master?s Supplemental Recommendations Concerning Distribution of Settlement Funds. You can view each of these documents by clicking the links below:

In accordance with the Judgment and Order, the Court-Appointed Disbursing Agent (CADA) will commence the distribution of settlement checks within 30 days. Please be patient as this process is expected to take several weeks for class members to receive their checks.

Please note that in order for a class member?s settlement check to be disbursed, the CADA must have all necessary information for each claimant, including Date of Birth, Current Mailing Address, and Minor Representative/Successor information (if applicable). Case Update - September 6, 2013

On Thursday, September 5, 2013, the Special Master filed the Special Master's Report and Recommendations (concerning distribution of settlement funds) along with exhibits which detail the objection process, disposition of each objection, and final settlement awards for each claimant. You can view the Special Master's Report by selecting the link below:

Please note that Exhibit 2 (which is attached to the Report and Recommendations) only lists the names of those claimants who objected to their allocations. If you received an allocation letter and did not object, your name should not appear on Exhibit 2. Nevertheless, the Special Master has recommended that the District Court award you an amount based upon what was indicated in your allocation letter.

If you would like to object to the Special Master's Report and Recommendations, you must file your objection in the record on or before September 26, 2013 in accordance with FRCP 53. The Court will consider the Special Master's Report and Recommendations on the submissions, and does not intend to hold oral argument at this time.

No checks can be distributed until the District Judge acts upon the Special Master's Report and Recommendations. This may take several weeks. Please continue to check this website for further updates as they become available.

Case Update - August 9, 2013

The deadline to file objections to individual allocation awards was July 12, 2013. The Special Master is currently reviewing all submitted objections and will submit a Report and Recommendations to the United States District Court once all objections have been processed.

Claimants do not need to take any further action at this time. Once the United States District Court approves the final allocation list, the Court-Appointed Disbursing Agent will distribute settlement checks as soon as possible.

Case Update - June 14, 2013

Allocation letters were mailed on June 14, 2013. All allocations were determined using the court-approved Special Master's Recommendations Concerning Allocations and Objection Procedures. You may view a copy of this document by clicking the link below:

If you do not object to your allocation, you do not need to do anything at this time. If you DO object to your allocation, you must read and follow the Notice of Rights and Objection Instructions as outlined on the back of your allocation letter. All objections must be postmarked no later than July 12, 2013.
